Welcome to OctoPunk. By creating an account or using our services, you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using OctoPunk ("Service"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not create an account or use the Service.

2. Description of Service

OctoPunk is an alternative GitHub interface that provides enhanced functionality for browsing and managing GitHub repositories, issues, and pull requests. The Service requires a valid GitHub account and uses the GitHub API to access your GitHub data.

3. GitHub Authentication

OctoPunk authenticates directly with GitHub using your personal access token or OAuth device flow. You are responsible for maintaining the confidentiality of your authentication credentials and for all activities under your account.

4. Data Collection

The desktop app stores the following information locally on your Mac:

• Your GitHub user ID and username
• Your email address (as provided by GitHub)
• App preferences and cached GitHub content

5. Subscription and Payments

OctoPunk is free for public repositories. OctoPunk Pro, which unlocks private repository workflows, is available as an auto-renewable subscription through the Mac App Store. Payments are handled by Apple; by subscribing you agree to Apple's terms. Subscriptions auto-renew unless cancelled before the renewal date.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any systems
• Interfere with the proper functioning of the Service
• Violate GitHub's Terms of Service while using OctoPunk

7. Intellectual Property

OctoPunk and its original content, features, and functionality are owned by OctoPunk and are protected by applicable copyright, trademark, and other intellectual property laws.

8. Termination

We may terminate or suspend your account at any time, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately.

You may remove your configured GitHub authentication at any time through the application settings.

9. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

In no event shall OctoPunk be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via the application or email. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
